Title: Consideration and possible approval of an Outdoor Dining and Encroachment Permit for Inca located at 1440 Victorian Avenue, Sparks, Nevada.

Recommendation: Staff recommends that Council approve an Outdoor Dining and Encroachment Permit for Inca.

Agenda Item Brief: Request for approval of an Outdoor Dining and Encroachment Permit by INCA, Inc at 1440 Victorian Avenue. City has reviewed the request and recommends approval.

Background: : This Permit authorizes Inca to utilize 403 square feet of City sidewalk adjacent to the front door of the building located at 1440 Victorian Avenue, including the City planter (see attached site map).

Analysis: : Inca has paid a refundable Security Deposit in the amount of $250.00, and the first month’s rent in the amount of $27.50. Inca will be occupying a 13’ by 31’ parcel, totaling 403 square feet. The small area contains a 6’ by 6’ City planter. Inca has agreed to the inclusion of an Indemnification clause in the Outdoor Dining and Encroachment Permit to indemnify and hold harmless the City for any liability caused by Inca or anyone utilizing the space identified in the Outdoor Dining and Encroachment Permit. This permit is allowed by Sparks Municipal Code (SMC 5.77). The request for the permit has been reviewed by City Staff and Staff recommends approval.

Recommended Motion: I move to approve the Outdoor Dining and Encroachment Permit as outlined by staff.
