Title: Consideration and possible approval of Change Order No. 2 for Fire Station 4 Sewer Main, Bid No. 11/12-017, PWP-WA-2012-108 to A & K Earth Movers, Inc., for excavation of rock in the amount of $25,000.

Recommendation: Staff recommends that Council approve Change Order No. 2 for the Fire Station #4 Sewer Main Project, Bid No. 11/12-017, PWP-WA-2012-108, to A & K Earth Movers, Inc., in the amount of $25,000.
Financial Impact: $25,000 for this change order will be moved from CIP 12-6620 Lyyski Sewer Rehab Project which has been completed under budget. Funds for this change order will be encumbered in Account 604060 Program 12-6622.

Agenda Item Brief: Consideration and possible approval of Change Order No. 2 for the Fire Station #4 Sewer Main Project, Bid No. 11/12-017, PWP-WA-2012-108 to A & K Earth Movers, Inc., in the amount of $25,000. A buried rock formation was encountered in the trench excavation which required the use of a hydraulic rock hammer to remove. This unforeseen condition was a change in conditions of the excavation and added five work days to the excavation work. City staff recommends approval.
Background: On February 13, 2012, City Council awarded the construction of Fire station 4 Sewer Main project to A&K Earthmovers in the amount of $130,500. Change Order No. 1 in the amount of $24,022.57 was approved by the City Manager for costs incurred to stabilize a secondary access road to the fire station and for by-pass pumping due to weather delays and during the Easter Weekend. A buried rock layer was encountered during the excavation and the force account in the original contract was allocated to cover the rental cost of the hydraulic hammer. The current total contract price to A&K Earthmovers is $154,522.57.
Analysis: The attached Change Order No. 2 reflects the work required to excavate rock in the trench line where the new sewer line will be laid. This is a negotiated cost which contains the direct cost of equipment, labor and equipment O&M costs for this work. Due to the slower digging through the rock formation, the excavation took five additional days to complete. The request for Change Order No. 2 is being funded from expected savings in the current year’s CIP Project # 12-6620 Lyyski Sewer Rehab Project. If approved by the City Council the new total contract price with A&K Earthmovers will be $179,522.57.
Alternatives: 1. City Council could approve the Fire Station #4 Sewer Main Project as outlined by Staff. 2. City Council could reject the Fire Station #4 Sewer Main Project and provide direction to the City Manager.
Recommended Motion: I move to approve Change Order No 2 for the Fire Station #4 Sewer Main Project, Bid No. 11/12-017, PWP-WA-2012-108 to A & K Earth Movers, Inc., in the amount of $25,000.
