Title: Presentation, discussion and possible approval to of a Memorandum of Understanding (MOU) (AC-5284) between the City of Sparks and the International Association of Firefighters Local No. 1265 to add the title of Fire Plans Examiner and Inspector and to memorialize the understanding and agreement about the current pay practice for daylight savings.

Recommendation: The City Council approves the Memorandum of Understanding (MOU) with the International Association of Firefighters Local No. 1265 to add the title of Fire Plans Examiner and Inspector
Financial Impact: Funding for this position was approved by City Council in the final budget for fiscal year 2017. The pay practice for daylight savings has been in effect many years. No change is recommended.

Agenda Item Brief:

City Council approved the fiscal year 2017 budget, which includes the new needs position addressed in this agenda item.  This proposal recommends the corresponding change to the International Association of Firefighters Local, No. 1265 contract, Appendix A to allow city staff to implement the budget as approved.  In addition, the city has interpreted the contract to assign pay for daylight savings.  The MOU memorializes an understanding of the current pay practice as the accepted interpretation of the contract.



Background:

First, in regards to Appendix A changes, on May 23, 2016, the Sparks City Council approved the final budget for fiscal year 2017.  Included in the budget is funding for the position of a Fire Prevention Inspector I position.  However, the focus of the new employee as presented to council is to primarily add additional fire plans examination and investigation functions within the department.  In order to properly hire for this specific function, a separate title has been recommended in this agenda item. This agenda item addresses updates of the Appendix A necessary to allow city staff to implement the fiscal year 2017 budget as approved.

Second, the city has traditionally paid employees covered under the IAFF agreement who work during the extra hour associated with daylight savings time once per year when an hour is added, and has not docked employees working during a shift where daylight savings removes an hour of time.  The MOU attached simply memorializes the understanding about this pay practice as an interpretation of how to apply the contract.



Analysis:

Funding for the position of Fire Prevention Inspector I was approved in the fiscal year 2017 budget.  However, upon further review of the new needs request and in discussion with the department, the intention of the position is to add fire plans examination and inspection roles specifically.  The Fire Department and City staff feel that this would be best accomplished with the addition of a new job title that captures the spirit of what was approved in the budget.  This will allow the department to recruit for a candidate with the specific job skills required to carry out this function, and to focus the efforts of the new employee on the roles identified as a new need.  In order to accomplish this, the addition of the title of Fire Plans Examiner and Inspector to Appendix A is recommended:

Under the MOU attached, both parties memorialize the understanding about the existing pay practice for daylight savings time.

  2. The City Council may not approve the Memorandum of Understanding with the International Association of Firefighters, Local No. 1265
  3. The City Council may not approve the Memorandum of Understanding with the International Association of Firefighters, Local No. 1265, but provide other direction to city staff.


Recommended Motion:

I move to approve the Memorandum of Understanding with the International Association of Firefighters, Local No. 1265.
