Title: Consideration and possible approval of Truckee Meadows Water Authority Water Service Agreement, Water Rights, and Meter Fund Contribution for Pelican Park, to Truckee Meadows Water Authority (TMWA), in the amount of $32,317.20 FOR POSSIBLE ACTION.

Recommendation: Staff recommends that Council approve Truckee Meadows Water Authority Water Service Agreement, Water Rights, and Meter Fund Contribution for Pelican Park, to Truckee Meadows Water Authority (TMWA), in the amount of $32,317.20.
Financial Impact: Contained in the approved 5-Year Capital Improvement Plan (CIP), for Year 1 is a $100,000 appropriation for Unexpected Park District 3 Projects, CIP 123500. A new project will be created and $32,317.20 of budget will be moved to cover this unplanned project. Expenses in providing a water source for this project will be charged to 604040, Land- Capital, using Project 12-12-3500A-100.

Agenda Item Brief: Consideration and possible approval of Truckee Meadows Water Authority Water Service Agreement, Water Rights, and Meter Fund Contribution for Pelican Park, to Truckee Meadows Water Authority (TMWA), in the amount of $32,317.20. This contract is for the installation of items required for providing water service at Pelican Park.


Background: On July 15, 2011, the Community Services Department received the annual Washoe County Delinquent Property List for 2011. The Delinquent List is prepared by the Washoe County Treasurer’s Office, and approved by the Board of County Commissioners. In the Delinquent Property List was Assessor’s Parcel Number 522-922-09, which is a 4.06 acre parcel of land which the original developer was to construct a City park, commonly referred to as Pelican Park. The developer did not complete all of the construction of the Park, nor has the developer paid property taxes on the property for the past two (2) years. The Washoe County Treasurer’s Office, as Trustee for Washoe County, has taken possession of the property, and proposes to place the property up for sale. The City has the first priority in acquiring this property and has started the process with the Washoe County Treasurer’s Office. Currently the landscaping is being provided water from a separate source and not metered and billed directly to the City of Sparks.

Analysis: Based on the City’s intent to acquire the property and the need to maintain the existing mature landscaping in place, the City has requested the attached TMWA Service Agreement to provide the necessary irrigation.

Alternatives: 1. City Council could approve the agreement as outlined by Staff. 2. City Council could reject the agreement and provide direction to the City Manager.

Recommended Motion: “I move to approve the Truckee Meadows Water Authority Water Service Agreement, Water Rights, and Meter Fund Contribution for Pelican Park, to Truckee Meadows Water Authority (TMWA), in the amount of $32,317.20.”
