Agenda Item Brief: On April 12, 2012, the City Legal Department denied this application due to nonconforming uses per the Sparks Municipal Code (SMC) 20.07.030, citing nonconformance to current C2 (General Commercial) zoning. The applicant is appealing this decision.
Background: The application was submitted by Scolari's to expand the nonrestricted gaming operations at the property located at 950 Holman Way, Sparks, NV. The applicant's attorney states that they believe the denial is based upon an inaccurate interpretation of the SMC and Nevada Gaming Control Act.
