Agenda Item Brief: This is a request for a second amendment to an existing agreement with the City of Reno and Limno Tech, Inc. for continued technical services in an amount not to exceed $250,000. Limno Tech, Inc is providing technical services in support of the Truckee River water quality standards and third party review of Total Maximum Daily Loads (TMDL) for nutrients. The Western Regional Planning Commission (WRWC) will fully fund this amended agreement. As such there will be no direct cost to the City of Sparks. Staff recommends approval.
Background: The Cities of Sparks and Reno, Washoe County, and the Truckee Meadows Water Authority are working in the role of third party with the Nevada Division of Environmental Protection (NDEP) and United States Environmental Protection Agency (USEPA) to review and potentially modify the Truckee River Water Quality Standards and Total Maximum Daily Loads (TMDL) for nutrients on the Truckee River. In an effort to study and model the nutrient loading on the Truckee River, Limno Tech was retained by the Cities to provide technical services to support the third party review efforts. On July 28, 2008 the City of Sparks City Council approved an agreement (A-3676) with the City of Reno and Limno Tech, Inc (LTI) for professional services related to Water Quality Standards and review of Total Maximum Daily Loads for the Truckee River for a total contract amount of $340,000 to be shared by the City of Sparks, City of Reno and the Western Regional Water Commission (attached). On September 12, 2009, the City of Sparks City Council approved amendment #1 to agreement A-3676 with the City of Reno and LTI for additional technical services for an amount not to exceed $400,000 to be funded completely by the WRWC. Analysis: Earlier this year, the NDEP and USEPA concluded that a review of the Lahontan reservoir water quality standards must move forward in advance or concurrent with the Truckee River water quality standards. Consequently, the process schedule has slowed. There are two water quality models being used for the review process; the first is one that simulates nutrient loading inputs from the watershed given various conditions. The second is a model that looks at the relationships between nutrient inputs, river conditions, and water quality standards. These water quality models for the Truckee River have been calibrated and verified and are being used for the water quality standards review process. LTI has the technical expertise to update these models and run various scenarios as well as knowledge of regulatory considerations and stakeholder communications for WQS and TMDLs. While these are not proprietary models, local staffs do not have the time or expertise. The outcome of the WQS review process has implications for regulating, permitting and monitoring the discharges to the Truckee River. Approval of the proposed amendment will allow LTI to perform the necessary technical services for the third party review efforts.
Alternatives: 1. The City Council could approve the proposed amendment as outlined by staff. 2. The City council could deny the proposed amendment and provide direction to the City Manager for revision to the proposed amendment.
