Title: Consideration, 1st Reading and possible discussion of Bill No. 2644, an Ordinance amending Chapter 15 of the Sparks Municipal Code; amending Section 15.05.100 "Adoption” and Section 15.05.108.3.9 "Energy Efficiency Inspections," to reflect the adoption of codes and local amendments; and providing other matters properly related thereto.

Agenda Item Brief: In May 2009, SB73 was signed into law, establishing the standards adopted by the Nevada State Office of Energy as the minimum standards for building energy efficiency and conservation. The law requires local governments to adopt and enforce the most recent version of the IECC. Adoption of the proposed bill will amend, by ordinance, Title 15 of the Sparks Municipal Code to include the changes required by the State of Nevada.


Background: In February 2009, the State of Nevada accepted $34.7 million from the U.S. Department of Energy (DOE) State Energy Program (SEP) and certified that Nevada would implement energy standards of the latest national model residential and commercial energy codes - the 2009 International Energy Conservation Code (2009 IECC) and ASHRAE Standard 90.1 - 2007. The State of Nevada is required to achieve 90 percent compliance in new and renovated buildings by 2017. In May 2009, SB73 was signed into law, establishing the standards adopted by the Nevada State Office of Energy as the minimum standards for building energy efficiency and conservation. The law (NRS 701.220) requires local governments to adopt and enforce the most recent version of the IECC.

Analysis: The adoption of the proposed bill will amend, by ordinance, Title 15 of the Sparks Municipal Code (SMC0 to include changes mandated by Nevada State Office of Energy. Specifically, the proposed bill will amend the following sections of Title 15: • Section 15.05.100 – Adoption of the 2009 International Energy Code (IECC) to replace the 2006 IECC, exclude sections referencing the 2006 IECC in the 2007 Northern Nevada Amendments and include adoption of the 2011 Northern Nevada Amendments. • Section 15.05.108.3.9 – Energy efficiency inspections. Language will be added to give the Building Official authority to require specific tests to assure compliance with the code.

Alternatives: The City Council may choose to reject the amendment to the ordinance and provide direction to Staff.

Recommended Motion: Staff recommends that the City Council instruct the City Clerk to read the First Reading of the Bill by title on June 11, 2012, and thereafter publish notice of a Second Reading and public hearing of this Bill for its possible approval and adoption on June 25, 2012.
