Recommendation: Staff recommends City Council approve the professional services contract with Kaempfer Crowell.
Financial Impact: Approving the professional services contract will cost the City $120,000.00 over the two-year term. The amounts due during the remainder of FY21 have been accounted for in the approved budget, and the fees for the remainder of the term will be addressed through the budget processes for FY22 and FY23.

Agenda Item Brief:

If the proposed professional services contract is approved, Kaempfer Crowell, Ltd., would provide lobbying and consulting services during the upcoming session of the Nevada Legislature and in the subsequent months. In exchange, the City would pay Kaempfer Crowell a flat fee of $5,000.00 per month for the two-year term of the agreement.



Background:

In preparation for the 2021 session of the Nevada Legislature, the City's legislative team met with various firms to discuss the possibility of their representing the City in lobbying and consulting efforts. After those discussions, the City's legislative team selected Kaempfer Crowell, Ltd., a Nevada law firm that specializes in legislative affairs, among other areas. Kaempfer Crowell's legislative affairs team is led by Michael Hillerby, Esq., who has been lobbying in Nevada since 1991. The proposed professional services contract and proposal are attached to this staff report.



Analysis:

Under the proposed agreement, Kaempfer Crowell will represent the City's legislative and political interests before, during, and after the 2021 legislative session. Kaempfer Crowell will be the City's primary representative during the legislative session. Kaempfer Crowell representatives will meet with legislators, provide feedback and testimony regarding bills, advocate for the City's legislative platform, and provide updates to the City's legislative team regarding the development and progress of various legislation. These updates include meetings, written communication, teleconferences, and Kaempfer Crowell's web-based bill tracking system. When needed, Kaempfer Crowell will also faciliate meetings and communications between City officials and Nevada legislators.

In exchange for these services, the City would pay Kaempfer Crowell $5,000.00 per month for the two-year term of the agreement. If approved, the proposed agreement would take effect immediately and run through December 31, 2022. Thus, the annual cost of the agreement is $60,000.00, and the total cost for the two-year term is $120,000.00. Staff recommends that City Council approve the agreement with Kaempfer Crowell.



Alternatives:

1. City Council may approve the agreement with Kaempfer Crowell as recommended by staff.

2. City Council may reject the agreement and give further direction to the City Manager.



Recommended Motion:

I move to approve the two-year professional services contract (AC-5726) with Kaempfer Crowell, Ltd., for Nevada Legislature lobbying and consulting services, in a total amount not to exceed $120,000.00.
