Agenda Item Brief:

This Resolution would repeal Resolution No. 3344 regarding salaries and benefits for executive employees, which was rendered redundant by City Council's approval of individual employment agreements for executive employees on November 9, 2020.



Background:

The City of Sparks previously provided for salaries and benefits for executive employees through a combination of a resolution and individual employment agreements. Resolution No. 3344 is the most recent version of the City's "Executive Resolution." The Executive Resolution governs the following positions: both Assistant City Managers, Chief Financial Officer, Police Chief, Fire Chief, Human Resources Director, and Parks and Recreation Director. On November 9, 2020, the City Council approved individual employment agreements with the employees in those positions, with the exception of the Parks and Recreation Director, which is currently filled on an acting basis. The November 9 agreements address salaries and all benefits for these employees, rendering the Executive Resolution redundant. When the Parks and Recreation Director position is filled permanently, that employee's agreement will similarly address salary and all benefits.



Analysis:

All matters in the Executive Resolution are now addressed by the employment agreements, eliminating the need to consult two separate documents to determine an employee's benefits. Because the Executive Resolution is now redundant, repealing it will not change any employee's salary or benefits but will eliminate the potential for confusion or disputes regarding benefits. Therefore, approval of Resolution No. 3368, which repeals the Executive Resolution, is recommended.



Alternatives:

1. City Council may approve Resolution No. 3368, repealing the Executive Resolution.

2. City Council may reject Resolution No. 3368 and give further direction to the City Manager.



Recommended Motion:

I move to approve Resolution No. 3368, repealing Resolution No. 3344 regarding salaries and benefits for executive employees.
