The amounts due during the remainder of FY21 have been accounted for in the approved budget, and the fees for the remainder of the term will be addressed through the budget processes for FY22 and FY23.

Agenda Item Brief:

If the professional services contract is ratified, Hardy Consulting Group, LLC, would provide lobbying and consulting services during the upcoming session of the Nevada Legislature and in the subsequent months. Hardy Consulting's services to the City of Sparks would be coordinated with the Cities of Henderson, Las Vegas, and Reno, which will each have separate contracts with Hardy Consulting for the same purpose. The City of Sparks would pay Hardy Consulting a flat fee of $2,000.00 per month from January through June of 2021, and $1,000.00 per month for the remainder of the two-year term of the agreement.



Background:

In preparation for the 2021 session of the Nevada Legislature, City staff consulted with their counterparts in the Cities of Henderson, Las Vegas, and Reno regarding coordinating certain lobbying and consulting efforts. Together, staff from the four cities agreed that Hardy Consulting would effectively represent the shared interests of the four cities during the legislative session. Hardy Consulting is led by Warren B. Hardy II, who has been engaged in government affairs work in Nevada since 1994. Because the value of the contract is less than $50,000.00, the City Manager approved the professional services contract pursuant to Sparks Municipal Code 2.25.150(A). However, given the importance of this legislative session to the City's future, staff wanted to provide the City Council the opportunity to review and ratify this contract.



Analysis:

Under the proposed agreement, Hardy Consulting will represent the four cities' shared legislative and political interests before, during, and after the 2021 legislative session. Hardy Consulting representatives will meet with legislators, provide feedback and testimony regarding bills, advocate for the cities' shared legislative agenda, and provide updates to the City's legislative team regarding the development and progress of various legislation. These updates include meetings, written communication, and teleconferences. When needed, Hardy Consulting will also faciliate meetings and communications between Nevada legislators and officials representing the four cities.

In exchange for these services, the City would pay Hardy Consulting $2,000.00 per month between January and June of 2021, and $1,000.00 per month for the remainder of the two-year term of the agreement. Thus, the cost of the agreement is $18,000.00 in 2021 and $12,000.00 in 2022. Staff recommends that City Council ratify the City Manager's approval of the agreement with Hardy Consulting.



Alternatives:

1. City Council may ratify the City Manager's approval of the agreement with Hardy Consulting as recommended by staff.

2. City Council may decline to ratify the agreement and give further direction to the City Manager.



Recommended Motion:

I move to ratify the City Manager's approval of the two-year professional services contract (AC-5727) with Hardy Consulting Group, LLC, for Nevada Legislature lobbying and consulting services in a total amount not to exceed $30,000.00.
