Title: Public hearing, consideration and possible approval of the abandonment of an approximate 25 foot by 135 foot Access Easement adjacent to the west side of Parcel 3 AND an approximate 30 foot by 145 foot Access Easement adjacent to the east side of Parcel 3, granted to the City pursuant to Parcel Map 2628, as recorded August 26, 1992.

Recommendation: Staff recommends Council approve the abandonment of the approximate 25 foot by 135 foot Access Easement adjacent to the east side of Parcel 3 AND the approximate 30 foot by 145 foot Access Easement adjacent to the west side of Parcel 3, granted to the City pursuant to Parcel Map 2628, as recorded August 26, 1992, as further described on the attached Exhibits “A” and “B”.

Agenda Item Brief: Consideration and possible approval of a request from Flower Point, LLC to abandon a 25 foot by 135 foot Access Easement AND a 30 foot by 145 foot Access Easement adjacent to the east and west sides of Parcel 3 as granted to the City as Parcel Map 2628, containing areas of 3352 square feet and 3466 square feet more or less., as further described in the attached Exhibits “A” and “B”. Staff recommends approval.


Background: The Access Easements fall within the ownerships of Flower Point, LLC, and Western Metals Recycling. The Access Easements are not used by the two effected owners or the general public, and has become an area of neglect, and dilapidated gravel and concrete. Flower Pointe LLC, the Applicant, will fence off the Access Easements and maintain the abandoned property.

Analysis: Staff recommends the Council approve the Access Easement abandonment request from Flower Point, LLC. The Access Easements are not required for road purposes now or in the future. The abandonment of the two parcels of land will return a combined 6818 square feet to the tax rolls.

Alternatives: 1. The City Council could approve the abandonment as outlined by staff. 2. The City Council could reject the abandonment and provide direction to the City Manager. 3. The City Council could direct the City Manager to provide alternatives to this proposal.

Recommended Motion: I move to approve the vacation of the Access Easement areas as outlined by staff.
