This Agreement is entered with Sparks Stonebrook, LLC for the Impact Fee Service Area #1 (IFSA #1) impact fee credit program. Impact Fee Agreement #29 is a master agreement that will allow Sparks Stonebrook, LLC to participate in the impact fee program. This agreement has been reviewed by the Impact Fee administrator and the City Attorney's Office and has been found acceptable. Staff recommends approval.
Background:
The Impact Fee Agreement contemplated in this staff report is a master agreement that allows developers to participate in the impact fee program established for IFSA #1, and establishes the administrative rules for the use of impact fee credits within IFSA #1. Upon approval, Sparks Stonebrook, LLC will be eligible to receive impact fee credits for construction of Capital Improvements within the service area. The following infrastructure types are eligible for credits within IFSA #1:
- Sanitary Sewer
- Flood Control
- Parks and Recreation
- Fire Station Projects
Analysis:
Pursuant to NRS Chapter 278B, the City enacted an Impact Fee Ordinance establishing IFSA #1 and approving the Capital Improvements Plan which imposes impact fees to finance infrastructure projects necessitated by, and attributable to, new development in that service area. Currently, the Sparks Council has approved the attached standard agreement with twenty-eight (28) different developers within IFSA #1.
Alternatives:
- The City Council may approve Impact Fee Agreement No. 29 as submitted.
- The City Council may reject Impact Fee Agreement No. 29 and provide direction to the City Manager.
Recommended Motion:
I move to approve Impact Fee Agreement No. 29 (AC-5622) with Sparks Stonebrook, LLC to allow for participation and use of credits in Impact Fee Service Area No. 1.
