Title: Consideration, discussion and possible approval of an Outdoor Dining and Encroachment Permit (AC-5554) to Engine 8 Urban Winery located at 1260 Avenue of the Oaks, Suite 140-160, Sparks, NV

Recommendation: Staff recommends City Council approve the Outdoor Dining and Encroachment Permit as submitted.
Financial Impact: The annual license fee, paid by the owner, will be $1,834.88.00 for fiscal year 18/19.

Agenda Item Brief:

Wendi Rawson, owner of Engine 8 Urban Winery, has requested an outdoor dining and encroachment permit over approximately 1,592 square feet of public right-of-way directly in front of the Avenue of the Oaks.  Staff recommends the Council approve the permit.



Background:

We have a request from Wendi Rawson, owner of Engine 8 Urban Winery to encroach 1,592 feet into the sidewalk area directly in front of the Engine 8 Urban Winery located at 1260 Avenue of the Oaks, Suites 140, 150, and 160.  This Outdoor Dining and Encroachment Permit is for a new business but using the same form and proposed terms previously used on Victorian Avenue with similar businesses.  The agreement includes review and approval by the City Council, an annual rent payment consistent with the City’s fiscal year, requirement of a Certificate of Insurance and Workman’s Compensation at the time of the annual permit application and general conditions for the protection and upkeep of the encroachment area.  The term for the agreement is for (3) three months and will need to be renewed on or prior to June 30, 2019 for fiscal year 2020.



Analysis:

The attached agreement has been reviewed by city staff and has been found acceptable and consistent with SMC 5.77.100.  Staff recommends approval.



Alternatives:
  1. The City Council could approve the Outdoor Dining and Encroachment Permit as outlined by staff.
  2. The City Council could reject the Outdoor Dining and Encroachment Permit and provide direction to the City Manager.


Recommended Motion:

I move to approve the Outdoor Dining and Encroachment Permit (AC-5554) for Engine 8 Urban Winery as submitted by staff.
