In 1957, Dr. Albert and Vicky DeMers purchased 1408 Pyramid Way.  In approximately 1966, Dr. and Mrs DeMers installed an underground swimming pool surrounded by a 3-foot masonry fence with a 3-foot chain-link fence along the L street side of the improvement.  The fence improvements were constructed on a portion of public right-of-way.  The abandonment request along L Street will allow the existing fence to be placed within the property.

Erick Baer, Trustee of the AB Living Trust, made an abandonment request on April 27,2018.  Each owner of property abutting the proposed abandonment have been properly notified via certified mail as required by NRS 278.480 (4) (a).  The extent of the proposed abandonment and the date of the public hearing was published in the Reno Gazette Journal on July 9, 2018 as required by NRS 278.480 (4) (b).  Reservations of easement (per NRS278.480 (6)) are included where applicable.  Staff finds that the public will not be materially injured by the proposed abandonment.  The abandonment order for the requested abandonment has been reviewed by staff and has been found acceptable and recommends approval. Refer to the attached abandonment order and associated exhibits. 

1. The City Council could approve the request for abandonment as outlined by Staff.
2. The City Council could deny the request for abandonment and provide direction to the City Manager.

I move to approve the abandonment of a portion of L Street public right-of-way adjacent to 1408 Pyramid Way (APN 033-011-24) per request from AB Living Trust to the City of Sparks.
