Agenda Item Brief: Consideration and possible approval of Resolution No. 3207, Consenting to the Relinquishment and Land Transfer Agreement of portions of Victorian Avenue extending from Twenty-first Street to Rock Boulevard, a distance of approximately 0.33 miles. The State of Nevada, Department of Transportation, proposes to relinquish to the City of Sparks portions of Victorian Avenue per the Stewardship Agreement between the Department of Transportation and the City of Sparks dated August 12, 2005, as amended. This Resolution is the final road segments being processed per this Stewardship Agreement. Staff recommends approval.


Background: The State of Nevada, acting by and through its Department of Transportation, and the City of Sparks entered into a Stewardship Agreement dated August 15, 2005 whereby the Department of Transportation agreed to relinquish eight (8) Permanent Easements acquired by the Department of Transportation for Project STP-0031(073) E.A. 73300- Victorian Avenue. On August 12, 2005 the City and the Nevada Department of Transportation (NDOT) entered into a Stewardship Agreement (PR612-05-063) with a Project cost of $631,579.00, with a City match of $312,579.00. On June 20, 2006, an Amendment to the Stewardship Agreement was approved by the City and NDOT increasing the project cost to $1,263,158.00, with a City match of $63,158.00. On December 19, 2007 Amendment 2 to the Stewardship Agreement was approved by the city and NDOT. This amendment inserted language to relinquish to the City all Permanent Easements acquired by NDOT for the Project. On December 31, 2007 an Amendment 3 to the Stewardship Agreement was approved by the city and NDOT. Amendment 3 changed the project Termination date from December, 2007 to December, 2008.

Analysis: NDOT acquired eight (8) Permanent easements, which according to Amendment 2 to the Stewardship Agreement (PR612-05-063) were to be relinquished to the City. The RESOLUTION CONSENTING TO THE RELINQUISHMENT AND LAND TRANSFER AGREEMENT reflects the eight (8) Permanent Easements NDOT acquired for the Project that are to be relinquished to the City. The attached Exhibits “A”, “B, “C”, “D”, ”E”, “F”, “G”, and “H” show thereon the areas on Victorian Avenue where NDOT acquired Permanent Easements for relinquishment to the City. A copy of the agreement is attached for the Council’s review.

Alternatives: 1. City Council could approve the attached Resolution Consenting to the Relinquishment and Land Transfer Agreement, as outlined by Staff. 2. City Council could reject the attached Resolution Consenting to the Relinquishment and Land Transfer Agreement, and provide direction to the City Manager.

Recommended Motion: “I move to approve the Resolution No. 3207, Consenting to the Relinquishment and Land Transfer Agreement for portions of Victorian Avenue.”
