Agenda Item Brief:

This interlocal agreement (ILA) is between the City of Sparks, City of Reno, Washoe County, and the Regional Transportation Commission of Washoe County (RTC) and defines the roles and responsibilities of each entity for the imposition, collection, and administration of Regional Road Impact Fees (RRIF).   The agreement has been approved by the RTC, City of Reno, and Washoe County.  Staff has reviewed the ILA (attached) and recommends approval.



Background:

On October 9, 1995 the City of Sparks City Council approved an interlocal cooperative agreement (Agreement A-2251) with the City of Reno, Washoe County, and the Regional Transportation Commission of Washoe County (RTC), for the impostion, collection, and adminstration of Regional Road Impact Fees (RRIF).  This agreement has expired and legal staff from the RTC, City of Sparks, City of Reno, and Washoe County have prepared an update to the ILA for consideration.  The attached agreement has been approved by the RTC, City of Reno and Washoe County.



Analysis:

The proposed agreement will define the duties and responsibilities between the RTC, the City of Sparks, the City of Reno and Washoe County for the imposition, collection, and administration of Regional Road Impact Fees (RRIF) pursuant to NRS 277 and NRS 278B.

With approval of this agreement the City of Sparks agrees to:

  • Establish a capital improvements advisory committee (CIAC) for the review of land use assumptions, designation of regional roads per the master plan, review of capital improvements, proposed impact fees per service level, and to adopt an ordinace requiring all impact fees collected to be deposited into an interest bearing account.  The City of Sparks has designated the Sparks Planning Commission to act as the CIAC in May of 2001 by approving resolution 2729.  The City of Sparks adopted Ordinance 1878 in October of 1995 that imposes Regional Road Impact Fees on all new development.
  • Impose and collect an impact fee within its jurisdiction.  The City of Sparks adopted Ordinance 1878 in October of 1995 that imposes Regional Road Impact Fees on all new development.
  • Transmit the collected impact fees quarterly to the RTC.
  • Transfer to the RTC the administration of their Regional Road Projects identified in the Capital Improvements plan.
  • Execute offset agreements between the RTC, the local jurisdiction, and one or more developers, which will define the conditions under which RTC and the local jurisdiction agree to own a Regional Road Project built in whole or in part by a developer, after construction and/or dedication and acceptance.
  • Accept dedication of Regional Road Projects constructed in whole or in part by RTC or by a developer in accordance with an offset agreement.
  • Maintain the Regional Road Projects offered for dedication as accepted by Sparks and Reno respectively.

 



Alternatives:

1. The City Council could approve the agreement as outlined by staff.

2. The City Council could reject the agreement and provide direction to the City Manager.

I move to approve the interlocal agreement (AC-5108) regarding regional road impact fees pursuant to NRS Chapter 277 and Chapter 278B.
