Title: Consideration and possible approval of a quit claim deed to correct an error made in a property transfer between the City of Sparks and the Miramonte Homeowners Association.

Recommendation: It is recommended that the quit claim deed be approved by Council to correct an error in a prior land dedication.

A Business Impact Statement is not required because this is not a rule.

Agenda Item Brief:

The Council is being asked to approve a quit claim deed transferring property back to Miramonte Homeowners Association. The property was mistakenly dedicated to the City in a previous transaction.

Background:

It was recently discovered that the wrong parcel of land was dedicated to the City. In order to correct this mistake it is necessary for the City to deed the parcel back to Miramonte Homeowners Association. The City received the correct parcel from Miramonte Homeowners Association in a seperate dedication.

Analysis:

The execution of the quit claim deed will correct an error which dedicated the wrong piece of property to the City and the quit claim deed will return ownership to the Miramonte Homeowners Association.

Alternatives:

The Council could deny the motion, however, the City would be in possession of piece of property it unintentionally received.

Recommended Motion:

I move to approve the quit claim deed which will return the property to the Miramonte Homeowners Association.
