Title: Second Reading, discussion, and possible adoption of Bill No. 2684, an ordinance amending Chapter 13 of Sparks Municipal Code modifying environmental control and pretreatment standards and defining post construction storm water quality management; and providing for other matters properly related thereto.

Agenda Item Brief: On March 24, 2014 City Council approved a request by Community Services staff to initiate amendments to Title 13 of Sparks Municipal Code. This request was made in regards to environmental control, pretreatment, stormwater management, Septage receiving, effluent, and other sections as necessary. The proposed amendments have been prepared and are presented within the proposed bill. First reading of Bill No. 2684 occurred on August 25, 2014. Adoption of the proposed bill will amend, by ordinance, Title 13 of the Sparks Municipal Code.

Background: Conveyance, treatment, and discharge of sanitary sewage, storm drainage, and reclaimed effluent within the City of Sparks is controlled by a myriad of permits as well as local, State, and Federal regulations. Title 13 (City of Sparks Water and Sewage Code) provides guidance and requirements to citizens and businesses in meeting these regulations and permits. Over time, regulations and permit requirements change. To maintain compliance, a review and possible update of Title 13 was required. Staff requested permission to review and prepare amendments to City Council on March 24, 2014; permission was granted and the proposed bill language was crafted.

Analysis: Adoption of the proposed bill will amend, by ordinance, Title 13 of the Sparks Municipal Code (SMC) modifying environmental control and pretreatment standards and defining post construction storm water quality management. Collectively, 59 sections of Title 13 are proposed to be amended. The proposed amendments include deletions of unnecessary, duplicate, or superseded definitions or code sections. Certain new sections were inserted to provide definition for User classes to match state or federal standards. Pretreatment, environmental control, and post construction storm water quality management sections received the bulk of the changes and additions to ensure compliance.

Alternatives:

City Council may choose to approve the amendment to the ordinance as presented.
City Council may choose to reject the amendment to the ordinance and provide direction to the City Manager.

Recommended Motion: That the City Council approve Bill No. 2684 as submitted.
