Public Hearing and Action Items Unrelated to Planning and Zoning: 10.2

Title: Second Reading, discussion, and possible adoption of Bill No. 2683, an ordinance amending Chapter 9 of the Sparks Municipal Code; revising provisions relating to convicted persons, sex offenders and persons convicted of nonsexual crimes against children; repealing provisions of the sparks municipal code pertaining to the registration of those persons, and thereby making state law solely applicable to such registrations; and providing other matters properly relating thereto.

Recommendation: That the City Council conduct a Public Hearing and adopt Bill No. 2683.
Financial Impact: Adoption of this bill will reduce administrative expenses at the Sparks Police Department.

Agenda Item Brief: Repeals requirement that the police department issue registration cards to sex offenders and that sex offenders carry such cards.


Background: In 2002, the City Council, acting upon the request of the Chief of Police, enacted an ordinance which required sex offenders to obtain and carry a registration card at all times. That requirement has not effectively aided law enforcement and the police department desires that the requirement be repealed.

Analysis: The elimination of registration cards for sex offenders will reduce the administrative burden at the police department. It will not have any effect on state law, which requires sex offenders to register with the police department.

Alternatives: The alternative to “do nothing” will continue an administrative program which is not enhancing law enforcement efforts against sex crimes. Those involved in the current registration card system visualize no significant changes by eliminating the registration cards. The alternative of approving the ordinance, and thereby eliminating the sex offender registration cards, is the preferred alternative.

Recommended Motion: I move to adopt Bill No. 2683, as submitted.
