Title: Consideration and possible adoption of Resolution # 3204 declaring a deed quitclaiming previously dedicated land or right-of-way to the Nevada Department of Transportation. FOR POSSIBLE ACTION

Agenda Item Brief: Adoption of the resolution which will allow the city to quitclaim previously dedicated land or right-of-way to Nevada Department of Transportation satisfying the obligations in the April, 2011 Interlocal Agreement.


Background: The previously dedicated land or right-of-way will be quitclaimed to the Nevada Department of Transportation (NDOT) which will fulfill the city’s obligations outlined in the Interlocal Agreement (ILA) which was approved by Council on April 11, 2011.

Analysis: On May 6, 1986, the Sparks Redevelopment Agency entered into an Interlocal Cooperative Agreement (ICA) with NDOT for the construction of the 14th Street off-ramp (a.k.a. Nugget Ave. ramp) and the 14th Street intersection. It was a condition of the ICA that Sparks acquire the necessary right-of-way to construct the 1986 ramp improvements. On April 11, 2011, The Sparks City Council approved an ILA with NDOT that outlined the transfer of roadway right-of-way for the Nugget Avenue improvements

Alternatives: 1. City Council could adopt the resolution as outlined by Staff. 2. City Council could reject the resolution and provide direction to the City Manager.

Recommended Motion: “I move to adopt Resolution # 3204 authorizing previously dedicated right-of-way to be quitclaimed to the Nevada Department of Transportation.”
