Agenda Item Brief: The North Truckee Drain Relocation Phase 1 Project will require various utility relocations to accommodate the new drainage infrastructure. NV Energy (NVE) has identified electrical service facilities requiring relocation, which were included in the Plans and Specifications for the Project. As the facilities being relocated are within Public Utility Easements (PUE), the relocation costs are the responsibility of the City of Sparks. An Agreement for the Adjustment of Utility Facilities has been prepared for payment of these costs by the City to NVE, and is presented for consideration. Staff recommends approval.
Background: The North Truckee Drain Relocation Phase 1 Project impacts various utility facilities. During the course of design, Truckee Meadows Water Authority (TMWA), Nevada Energy (NVE), Charter, AT&T, Verizon, and other known utility companies were notified and coordination ensued to ensure relocation needs were determined and properly included. As such, TMWA and NVE elected to include relocation work within the City of Sparks Plans and Specifications for the Project. Portions of the work included (namely facilities within Right-of-Way and covered by the associated franchise agreements) are eligible for reimbursement. Cost to relocate facilities located with Easements is not eligible for reimbursement, and as such the City must pay to relocate those facilities located as such. Negotiations with both TMWA and NVE have resulted in Reimbursement and Adjustment Agreements with the respective utility owners; presented with this staff report is an Adjustment of Utility Facilities Agreement for electrical facilities with NVE. Scope of work included in this Adjustment Agreement includes removal of an existing pole, removal of above and below ground conductors, and installation of new underground conductors and a vault structure. All facilities are located within Public Utility Easements outside of Right-of-Way; as such the cost to perform the work is the responsibility of the City of Sparks. Total estimated cost to the City is $115,050. Staff recommends approval.
Analysis: Approval of the presented Agreement for the Adjustment of Utility Facilities will allow NVE to recuperate costs incurred in relocating infrastructure owned by NVE and located outside of City Right-of-Way.
Alternatives: 1. City Council could approve the Agreement for Adjustment of Utility Facilities as outlined by Staff. 2. City Council could reject the Agreement for Adjustment of Utility Facilities and provide direction to the City Manager.
Recommended Motion: I move to approve an Agreement for the Adjustment of Utility Facilities for Phase 1 of the North Truckee Drain Relocation Project with NV Energy in the amount of $115,050.
