Agenda Item Brief:

In order to reduce risks to medical staff, Sparks Police Department is required to provide guard duty for high-risk subjects who are in custody while receiving medical treatment from local hospitals prior to transportation to the Washoe County Detention Facility. Sparks Police Department does not always have adequate staffing to provide such guard duty and has paid for Washoe County Sheriff's Deputies to perform this function in the past. This agreement memorializes that practice.



Background:

Sparks Police Department (SPD) is required to provide guard duty for high-risk subjects who are in custody while receiving medical treatment from local hospitals prior to transportation to the Washoe County Detention Facility. This guard duty requirement mitigates risks that potentially dangerous subjects may pose to medical staff. However, SPD does not always have adequate staffing to provide this guard duty while also providing adequate patrol officers. SPD has utilized the Washoe County Sheriffs Office for guard duty previously and has paid for those services through SPD's budget. This agreement memorializes this function and explains items such as authority and compensation.



Analysis:

SPD has been unable to provide the necessary personnel for hospital guard duty due to staffing issues for a variety of reasons. This agreement does not require Sparks Police Department to utilize the agreement at all. Rather, the agreement allows SPD to use the agreement at the discretion of the Chief of Police. If SPD does need services under the agreement, SPD will pay Washoe County Sheriff's Office for the hourly wages of those Deputies providing guard duty. The agreement is automatically renewing and may be terminated by either party with thirty (30) days' notice.



Alternatives:
  1. City Council may approve the agreement as outlined by staff.
  2. City Council may reject the agreement and provide direction to the City Manager.


Recommended Motion:

I move to approve the agreement (AC-5744) between Washoe County, through Washoe County Sheriff's Office, and City of Sparks, through Sparks Police Department, to pay Washoe County Sheriff Deputies to provide hospital guard duty to high-risk subjects requiring medical treatment when Sparks Police does not have staffing to provide guard duty.
