The City of Sparks (City) and the Sparks Police Supervisory Protective Association, Lieutenants (SPSPA) have reached a tentative Collective Bargaining Agreement (Agreement) with contractual changes for the period of July 1, 2020 to June 30, 2021.
Background:
The City negotiates and enters into labor agreements with its various collective bargaining units. The current agreement expired June 30, 2020. The City and SPSPA submit for your consideration a one (1) year Agreement covering July 1, 2020 through June 30, 2021.
The negotiation teams for both parties began meeting in spring 2020 and continued to meet regularly to discuss the terms and conditions of this Agreement. The Agreement proposed today is the result of those meetings. The City and SPSPA believe this Agreement to be a fair, good faith effort between both parties. SPSPA has ratified this Agreement with their membership and now the parties recommend ratification and approval by council.
Analysis:
The following is a summary of the Agreement reached between the parties. This summary outlines negotiated contract changes. Also attached to this Agenda is a strike-out version of the proposed Agreement and a final version of the proposed Agreement.
Summary of Tentative Agreement
Section 1: Administration, Article A: Preamble
Section was changed to reflect the name change of the bargaining unit from Sparks Police Protective Association (SPPA) to Sparks Police Supervisory Protective Association (SPSPA). There is no direct cost related to this contract change.
Section 1: Administration, Article D: Duration of Contract
Section was changed to reflect the new contract period of July 1, 20 through June 30, 2021. There is no direct cost related to this contract change.
Section 1: Administration, Article J: Related Business
Section was changed to reflect the name change of the bargaining unit from Sparks Police Protective Association (SPPA) to Sparks Police Supervisory Protective Association (SPSPA). There is no direct cost related to this contract change.
Section 2: Pay Rates, Article A: Pay Rates
Cost of Living Adjustments (COLA)
In this contract, contract language related to COLA increases prior to FY21 was removed and replaced per the tentative agreement between SPSPA and the City in which it is agreed that employees shall receive a COLA of 2.8% above the base salary rate in effect on June 30, 2020.

The total fiscal impact of the COLA over the next three (3) years to the General Fund is $99,000.
Section 4: Leave Benefits, Article B: Annual Leave
The current contract allows for a maximum accrual of four-hundred, eighty (480) hours of annual leave. This section has been modified to increase the number of maximum annual leave hours accrued to five hundred sixty (560).
Section 4: Leave Benefits, Article D: Catastrophic Sick Leave Bank
Section modified to clarify requests made for use of this bank must be made in writing to the Police Chief or their designee, the Human Resources Director or designee. Section also modified to reflect the change in bargaining unit acronym from SPPA to SPSPA.

Effective July 6, 2020, the City and SPSPA agree to change the pay band as follows.

Change in Bargaining Unit
The City and SPSPA agree to change all references to such representative in the Collective Bargaining Agreement from Sparks Police Protective Association or SPPA, to Sparks Police Supervisory Protective Association or SPSPA, with the exception of those provisions of the Collective Bargaining Agreement addressing membership of the Group Health Care Committee. There is no direct cost related to this contract change.
Alternatives:
- Council may choose to approve the proposed Collective Bargaining Agreement.
- Council may choose not to approve the proposed Collective Bargaining Agreement.
- Council may choose not to approve the proposed Collective Bargaining Agreement and direct the City Manager toward another alternative.
Recommended Motion:
I move to approve Collective Bargaining Agreement (AC-5700) between the City of Sparks and the Sparks Police Supervisory Protective Association, for the period of July 1, 2020 to June 30, 2021.
