Agenda Item Brief:

The Building Code Board of Appeals (BCBA) is an independent board created to hear appeals of decisions made by the Building Official regarding interpretations of the Building Code. The BCBA consists of five (5) members, each serving two-year terms. There are two (2) vacancies on the BCBA: One (1) registered professional with Structural/Civil Engineer experience and one (1) Mechanical Engineer or a mechanical/plumbing contractor, with at least 10 years of experience, 5 years being responsible charge of work. This agenda item is requesting the City Council approve the Building Official's recommended appointments to the BCBA.



Background:
NRS 278.270 through 278.310 provides the City with the authority to establish a board to hear appeals regarding inability to obtain a building permit or decisions of any administrative officer or agency based on or made in the course of the administration or enforcement of any regulation relating to the soundness of structures. In August 2002, Sparks City Council adopted an ordinance (2153) establishing an independent board to hear appeals of decisions made by the Building Official.
 
The BCBA consists of five (5) members, each serving two-year terms: 
 
  • Two (2) registered architects or builder/superintendent of building construction with at least 10 years of experience, five (5) years being responsible charge of work;
  • One (1) registered professional with Structural/Civil Engineer experience
  • One (1) Mechanical Engineer or a mechanical/plumbing contractor with at least 10 years of experience, five (5) years being responsible charge of work;
  • One (1) electrical Engineer or an electrical contractor with at least 10 years of experience, five (5) years being responsible charge of work.
Board members serve at the pleasure of the City Council; the Building Official makes recommendations to the Council for board appointments; members can seek reappointment for up to three (3) terms.


Analysis:
There are two (2) vacancies on the BCBA:
 
One (1) registered professional with Structural/Civil Engineer experience
One (1) Mechanical Engineer or a mechanical/plumbing contractor with at least 10 years of experience, five (5) years being responsible charge of work
 
The term for these vacancies is October 1, 2020 through September 30, 2022.
 
Building Official Mark Meranda recommends Brett McElhaney for the Structural/Civil Engineer vacancy and Matthew Myres for the Mechanical Engineer vacancy. Both are current BCBA members seeking reappointment. If appointed, this will be their second terms.


Alternatives:
  1. Council may approve the Building Officials recommendations for appointment.
  2. Council may deny the Building Officials recommendations for appointment and provide direction to the City Manager.


Recommended Motion:

I move to approve the Building Officials recommendation to appoint Brett McElhaney (Structural/Civil Engineer) and Matthew Myres (Mechanical Engineer) to the Building Code Board of Appeals, with terms ending September 30, 2022.
