The Community Health Alliance was incorrectly assessed the Regional Road Impact Fee (RRIF) associated with the building permit for a tenant improvement at 2244 Oddie Blvd. Sparks Municipal Code (SMC) Section 15.05.107.7.1 provides the City Council the authority to refund any fee that was collected in error.
Background:
During the review of building permit SBLD20-22277 to combine three tenant spaces for the Community Health Alliance, City staff erroneously calculated the area of improvement as 10,130 square feet. The actual area of the combined three tenant spaces is 8,968 square feet. The change in use from commercial space to medical office space does not generate a RRIF until the square footage is over 10,000 square feet.
Analysis:
The City of Sparks collects RRIF fees on building permits for increased traffic impacts and transfers the collected funds to the Regional Transportation Commission (RTC) on a quarterly basis. Due to the error in calculating the improvement area for the Community Health Alliance, the Community Health Alliance erroneously paid a RRIF of $40,609.85.The refund of this RRIF will be paid from the City's RRIF funds collected but not yet transferred to RTC and will not need to be reimbursed from RTC directly.
Alternatives:
- City Council could approve the refund as outlined by staff.
- City Council could reject the proposed refund and provide direction to the City Manager.
Recommended Motion:
I move to approve a refund of Regional Road Impact Fees to Community Health Alliance in the amount of $40,609.85.
