Tyler Gregory, owner of Packs & Pints LLC, has requested an outdoor dining and encroachment permit for approximately 435 square feet of public right-of-way directly adjacent to its storefront on Victorian Avenue.
Background:
Tyler Gregory, owner of Packs & Pints LLC, has applied to encroach upon 435 feet of the sidewalk area directly in front of Packs & Pints LLC located at 944 Victorian Avenue. This Outdoor Dining and Encroachment Permit is for a new business but using the same form and proposed terms previously used for other businesses in Victorian Square. The agreement includes review and approval by the City Council, an annual rent payment consistent with the City’s fiscal year, requirement of a Certificate of Insurance and Workman’s Compensation at the time of the annual permit application, and general conditions for the protection and upkeep of the encroachment area.
Analysis:
The attached agreement has been reviewed by City staff and has been found acceptable and consistent with SMC 5.77.100. Staff recommends approval.
Alternatives:
- Council could approve the Outdoor Dining and Encroachment Permit as outlined by staff.
- Council could reject the Outdoor Dining and Encroachment Permit and provide direction to the City Manager.
Recommended Motion:
I move to approve the Outdoor Dining and Encroachment Permit (AC-5675) for Packs & Pints LLC as submitted by staff.
