Agenda Item Brief:

Golden Rotisserie is a new restaurant located in Victorian Square at 1240 Avenue of the Oaks. This agenda item requests approval of an Outdoor Dining and Encroachment Permit for approximately 1,249 square feet of public right-of-way in the plaza area adjacent to the Golden Rotisserie. The amount of rent to be paid by Golden Rotisserie is $164.05 for the remainder of fiscal year 2019 (May 15 to June 30, 2019).



Background:

Jose Chavez is the owner of Golden Rotisserie, a new restaurant located at Victorian Square at 1240 Avenue of the Oaks (Suite 100). The business is located on the ground floor of the eastern mixed-use building developed by Silverwing Development known as Fountainhouse Phase II. Mr. Chavez has requested an Outdoor Dining and Encroachment Permit to use approximately 1,249 square feet of the plaza area directly adjacent to his restaurant for an outdoor dining area (Exhibit A).



Analysis:

This proposed Outdoor Dining and Encroachment Permit utilizes same form and terms previously used for similar businesses on Victorian Avenue and, most recently, for the Engine 8 Urban Winery in the western Fountainhouse Phase II mixed-use building. The agreement’s provisions address rent to be paid to the City, insurance requirements, indemnification of the City, and conditions for the use, protection and upkeep of the encroachment area. The initial term of the agreement is for the period from May 15 to June 30, 2019, for which the rent amount is $164.05. The permit will need to be renewed on or prior to June 30, 2019 for fiscal year 2020.

The attached agreement has been reviewed by the City Attorney and found acceptable and consistent with Section 5.77.100 of the Sparks Municipal Code.



Alternatives:
  1. The City Council could approve the Outdoor Dining and Encroachment Permit for Golden Rotisserie as outlined by staff.
  2. The City Council could reject the Outdoor Dining and Encroachment Permit for Golden Rotisserie and provide direction to the City Manager.


Recommended Motion:

I move to approve the Outdoor Dining and Encroachment Permit (AC-5567) for Golden Rotisserie.
