Title: Consideration and possible approval of appointments to the Sparks Building Code Board of Appeals for staggered terms to be filled from the following pool of applicants listed in alphabetical order: Frank Bidart; Mark DeWeese; Don Mackey; Brett McElhaney; Matthew Myres; Andrew Ngo; and Mike Pecorino.

Recommendation: The Building Official recommends City Council approve the following five (5) appointments to the Sparks Building Code Board of Appeals: Mark DeWeese, Don Mackey, Brett McElhaney, Matthew Myres, and Mike Pecorino.

Agenda Item Brief:

This agenda item is requesting City Council accept Building Official Mark Meranda's recommendation to appoint five applicants to the Sparks Building Code Board of Appeals. The purpose of the board is to hear appeals of decisions made by the City’s Building Official regarding interpretations of the Building Code. 



Background:
On September 9, 2002, the Sparks City Council enacted Ordinance No. 2153 establishing an independent board comprised of five persons to hear appeals of decisions made by the City Building Official regarding interpretations of the Building Code. The terms of the previously appointed board members expired November 12, 2007 and the positions have been vacant since then. The City of Sparks is in receipt of an appeal necessitating reactivation of the Board of Appeals.

            



Analysis:

Ordinance No. 2153 specifies that, subject to the availability of qualified applicants, the Sparks Building Code Board of Appeals shall include members with education and/or experience in the architecture, engineering and construction fields as follows:

• Two persons each of whom is either a registered professional with architectural experience or a builder or superintendent of building construction with at least 10 years of experience.
• One person who is a registered professional with structural and/or civil engineering experience.
• One person who is either a registered professional with mechanical engineering experience or a mechanical/plumbing contractor with at least 10 years of experience.
• One person who is either a registered professional with electrical engineering experience or an electrical contractor with at least 10 years of experience.

Notice of the vacancies for the Sparks Building Code Board of Appeals was announced at the February 25th and March 11th, 2019 City Council meetings. Seven applications were submitted to the Clerk's office. Ordinance 2153 provides that the Building Official shall transmit to the City Council a list of potential appointees to the Sparks Building Code Board of Appeals.

After reviewing the applicant qualifications, the Building Official recommends the City Council appoint Mark DeWeese, DR Horton Construction Services Manager, and Don Mackey, registered architect to two-year terms, expiring March 31, 2021; Brett McElhaney, registered professional structural engineer, and Matthew Myres, registered professional mechanical engineer, to 18-month terms, expiring September 30, 2020; and Mike Pecorino, registered professional electrical engineer, to a one-year term, expiring March 31, 2020.



Alternatives:

1.The Council may approve the five individuals recommended by the Building Official to the Sparks Building Code Board of Appeals.
2.The City Council may reject one or more of the recommended appointments and direct the Building Official to seek other individuals to serve as members of the Sparks Building Code Board of Appeals.



Recommended Motion:


I move to approve the following persons to the Sparks Building Code Board of Appeals: Mark DeWeese and Don Mackey to two-year terms, Brett McElhaney and Matthew Myres to 18-month terms and Mike Pecorino to a one-year term.
