Title: Consideration and possible approval of an amendment to Professional Services Agreement #A-2926 between the City of Sparks and Charles P. Cockerill, Attorney at Law, for labor-related legal representation services.

Recommendation: The City Council approve the Professional Services Agreement between the City of Sparks and Charles P. Cockerill, Attorney at Law, for labor-related legal representation services.

Agenda Item Brief: The City utilizes private labor-related legal representation. Mr. Cockerill and/or his partner has been providing these services since 1992 and provides a great sense of continuity to the City's labor relations and contract negotiation process. Mr. Cockerill is instrumental in providing expert legal services related to the all the City's labor issues.


Background: From time to time, the City of Sparks requires legal representation and advice from outside counsel on labor-related issues. Additionally, the City requires labor legal repesentation for all contract negotiation. Based on past performance and representation services provided over the years, the City desires to retain the legal services of Charles P. Cockerill to provide continuity in representation and advice on labor-related issues as incurred and assigned by the City.

Analysis: Mr. Cockerill works in conjunction with the City of Sparks' City Attorney's Office and provides legal counsel for labor negotiations, grievances, discipline and general employee issues. Additionally, Mr. Cockerill litigates on behalf of the City all labor-related issues as assigned by the City Attorney's office. Traditionally Mr. Cockerill represents the City for all arbitration proceedings related to labor contract negotiations, interpretation and employee grievances.

Alternatives: 1. The Council may choose to approve the Professional Services Agreement between the City and Charles P. Cockerill as presented by staff. 2. The Council may choose not to approve the Professsional Services Agreement between the City and Charles P. Cockerill as presented by staff. 3. The Council may choose not to approve the Professional Services Agreement between the City and Charles P. Cockerill as presented by staff and may provide alternative direction to staff.

Recommended Motion: I move to approve the Professional Services Agreement between the City of Sparks and Charles P. Cockerill, as presented by staff.
