Agenda Item Brief:

Sparks City Charter, Article 3 sets forth those provisions applicable to the Sparks City Attorney. Article 3, Section 3.050(1) (g) provides:

Sec.  3.050  City Attorney: Duties; Assistant City Attorneys.

      1.   The City Attorney shall:

      (g)  Not engage in any other business or occupation nor in the private practice of law without the approval of the City Council.

The City Attorney is seeking the City Council’s approval to obtain outside part-time employment with Western Nevada College.



Background:

With the permission of the Sparks City Council, the City Attorney previously instructed several adult classes for the University of Phoenix, Reno Campus, from 2003 to 2014. These courses were taught from 6:00pm to 10:00 pm and included criminal law/justice, business law/administration, Nevada and US Constitutions.

The University of Phoenix ceased its on-ground classes in Reno in late 2015.

Western Nevada College is a multi-year educational institution offering both vocational and traditional college degrees at various campuses throughout Northern Nevada. Western Nevada College has offered a part-time faculty position to the City Attorney for the fall, 2017 semester. These classes are scheduled for Wednesday evenings, from 7:00 p.m. to 9:45 p.m. in Fallon, NV beginning August 30, 2017 and concluding on December 13, 2017. Western Nevada College has also indicated the possibility of future teaching assignments beginning in 2018.



Analysis:

Since the City Council’s original approval to allow the City Attorney to teach part-time in 2003, a new City Council has been elected for the City of Sparks. In order to both comply with the Sparks City Charter and give the current City Council an opportunity to either continue in its assent or withdraw its consent to allow the City Attorney to teach part-time, this agenda Item is being presented.



Alternatives:

Pursuant to the Sparks City Charter, the City Council could withhold its approval to allow the City Attorney to accept a part-time faculty position at Western Nevada College.



Recommended Motion:

I move to approve the City Attorney's request to accept a part-time faculty position at Western Nevada College.
