Consideration and possible approval of the Sparks Municipal Court Indigent Defense Contract with Daniel McCormick, Esq. for a two-year term with the provision for yearly renewals.
Background:
As required by NRS 171.188 Sparks Municipal Court provides the indigent with legal representation if the accused is facing the imposition of a jail sentence. The Indigent Defense Contract attached for your consideration and approval would award the contract to Daniel McCormick, Esq. Under the terms of the contract Mr. McCormick will provide legal representation of indigent defendants during all stages of criminal proceedings in the Sparks Municipal Court including in-custody video arraignments, trials, hearings and all appeals to the Second Judicial District Court of Washoe County. The majority of cases assigned to Mr. McCormick are crimes of domestic battery, DUI charges, and other misdemeanor charges where a defendant is facing a jail sentence if convicted.
Analysis:
Mr. McCormick is currently the holder of the Indigent Defense Contract. During the time Mr. McCormick has represented the indigent in Sparks Municipal Court he has provided representation in a professional manner and he works with the Sparks Municipal Court on any necessary special set calendars, as well as processing all required documentation and billing in a timely manner. Sparks Municipal Court recommends the award of the Indigent Defense Contract to Mr. McCormick.
Pursuant to NRS 332.115(b) this contract award is not subject to bid requirements as it is professional services contract.
