Consideration and possible approval of a supplemental agreement with UPRR in the amount of $140,222. This supplemental agreement will modify the original agreement, License Audit No. 283911, by clarifying the installation and coordination of 140 lineal feet of double eight-foot square box culvert and 40 lineal feet of double six-foot square box culvert for transporting and conveying stormwater on railroad property. The work contained in the supplemental agreement is a component of the North Truckee Drain Phase 3 project.
Background:
The North Truckee Drain Realignment Project is an integral component of the Truckee River Flood Project to the City of Sparks. The North Truckee Drain Realignment Phase 3 Project limits begin on the west side of Greg Street and end approximately 700 feet east of Sparks Boulevard, and are generally located south of Interstate 80. The project work related to this agenda item consists of connecting to two existing culverts in UPRR right of way and removal of an existing railroad bridge (see attached Location Exhibit). A license to occupy UPRR right of way was obtained during project design; it was intended to execute the supplemental agreement once a general contractor was established for the North Truckee Drain Phase 3 project.
Analysis:
The attached supplemental agreement was drafted by UPRR and Community Services staff to clarify the construction methods and coordination of the general work outline in the base agreement. The cost of the agreement includes railroad safety flagging, engineering, surface preparation, and track replacement to be provided by UPRR.
Alternatives:
1. City Council could approve the supplemental agreement with UPRR as outlined by Staff.
2. City Council could disapprove the supplemental agreement and provide direction to the City Manager.
Recommended Motion:
I move to approve the supplemental agreement with Union Pacific Railroad.
