Title: Public Hearing, consideration and possible approval of a request from Triple D Properties, LLC to the City of Sparks for the abandonment of a portion of the right-of-way of South 21st Street.

Agenda Item Brief:

Triple D Properties, LLC  has made a request to the City of Sparks City Council for consideration of the abandonment of a portion of the right-of-way of South 21st Street abutting 555 South 21st (see attached site plan).  Staff has researched the request and is of the opinion that the public will not be materially injured by the proposed abandonment and recommends approval.



Background:

Triple D Properties, LLC  is the owner of property located at 555 South 21st Street. Triple D Properties is in the process of making improvement to the existing site (concrete batch plant and supporting structures) and has requested that the Sparks City Council consider the abandonment of a portion of the right-of-way of South 21st Street that abuts the western border of their property. Triple D Properties intends to reconstruct site fencing and access driveways along South 21st Street and will utilize the property included in the request for abandonment for parking.



Analysis:

The legal descriptions (see attached ) for the requested right-of-way abandonments have been reviewed by staff and have been found acceptable. Each owner of property abutting the proposed abandonments have been properly notified via certified mail as required by NRS 278.480 (4) (a). The extent of the proposed abandonment and the date of the public hearing were published in the Reno Gazette Journal  as required by NRS 278.480 (4) (b). Reservations of easment (per NRS 278.480 (6)) are included where applicable. Staff finds that the public will not be materially injured by the proposed abandonments and recommends approval.



Alternatives:
  1. The City Council could approve the request for abandonment as outlined by Staff.
  2. The City Council could deny the request for abandonment as outlined by Staff.


Recommended Motion:

I move to approve the request from Triple D Properties, LLC  to the City of Sparks for the abandonment of a portion of the right-of-way of South 21st Street.
