Title: Consideration and possible approval of an Interlocal Agreement (ILA) to provide environmental control inspection services in the Sun Valley General Improvement District.

Recommendation: Staff recommends City Council approve this Interlocal Agreement.
Financial Impact: There is no impact to the General Fund nor expenses to the Utilities Fund grouping. The revenue received is based off of annual inspections performed by Environmental Control for permit renewal of sanitary sewer customers within the Sun Valley General Improvement District (SVGID). Per the ILA SVGID will be invoiced monthly and the revenue will post to Account 402280, Environmental Control Discharge Permit, formerly known as Industrial Waste Discharge Permit. Since June 2010 Sparks has generated $19,159.00 in revenue.

A Business Impact Statement is not required because this is not a rule.
Agenda Item Brief:

Consideration and possible approval of the Pretreatment Inspection Services Interlocal Agreement with Sun Valley General Improvement District.



Background:

The City of Sparks provides sewer service to the Sun Valley General Improvement District (SVGID) and as required by EPA must establish jurisdiction of the industrial/commercial pretreatment program within SVGID.  Staff proposes to update the Pretreatment Inspection Services Agreement initiated and signed December 28, 1987, between the City of Sparks and SVGID.  This updated Interlocal Agreement will cover current on-site inspections and plan checking fees related to the existing and new businesses within the district.  Currently 23 Sun Valley businesses are permitted through the pretreatment program.

 



Analysis:

Principle changes to the agreement include the addition of USEPA required language specifically defining each entities legal responsibility with regard to a pretreatment program, as well as stating that Sparks is the designated agent of the District and has the authority to enter, inspect and enforce regulations.  Additionally, the ECS Permit fees were updated to current levels and the re-inspection fee currently in use by Sparks was added to the agreement.



Alternatives:

City Council could choose not to enact this updated version of the Interlocal Agreement with Sun Valley General Improvement District and provide direction to the City Manager.



Recommended Motion:

I move to approve the Interlocal Agreement with Sun Valley General Improvement District.
