At the October 12, 2015 City Council Workshop Councilman Ed Lawson requested that consideration be given toward an amendment to Title 17 of Sparks Municipal Code wherein the requirement for Final Subdivision Map to be approved by the Sparks City Council be removed. Title 17 can be amended to authorize the Administrator of the Community Services Department to approve final maps as allowed by NRS 278.378.
Background:
Title 17.20 of the Spark Municipal Code (SMC) requires that the Spark City Council approve all final maps prior to recordation by the county recorder. NRS 278.378 includes language that allows a final map to be presented to the county recorder for recordation under certificate by the clerk of the governing body or planning commission, or the director of planning or other authorized person or agency authorized to take final action by the governing body stating that the governing body, planning commission, director of planning or other authorized person or agency approved the map. As such, Title 17.20 of the SMC could be amended to authorize the Administrator of the Community Services Department to approve final subdivision map.
Analysis:
Under the current code, developers are required to submit final map documentation to the Community Services Department for technical review of the final map, civil improvement plans, landscape plans, bonding requirements and for conformance to the approved tentative map. Upon completion of all technical review and reciept of all final documents, the final map is agendized for review and approval on the Sparks City Council. As such there is a seventeen (17) day waiting period prior to approval and eventual recordation. Should the Council chose to direct staff to ammend Title 17 and authorize the Administrator of the Community Services Department to approve final maps, this waiting period could be greatly reduced.
Alternatives:
- The Council could direct staff to amend Title 17 of the Sparks Municipal Code to authorize the Administrator of the Community Services Department to approve final maps.
- The Council could chose to remain the approving body for Final Maps.
Recommended Motion:
"I move to direct staff to draft an amendment to Title 17 of the Sparks Municipal Code to authorize the Administrator of the Community Services Department to approve final maps."
