Title: Public Hearing, consideration and possible approval of a request from SWD-Quarry FVS, LLC to the City of Sparks for the abandonment of four parcels of right-of-way abutting the proposed Fountainhouse project.

Recommendation: Staff recommends the Council approve the request for the right-of-way abandonments.

Agenda Item Brief:

SWD-Quarry FVS, LLC is the owner of the Fountainhouse Project and has requested that the City of Sparks City Council consider the abandonment of four (4) parcels of right-of-way abutting the proposed project boundary (see attached site plan).  Staff has researched the request and is of the opinion that the public will not be materially injured by the proposed abandonments and recommends approval.



Background:

SWD-Quarry FVS, LLC is the owner of the Fountainhouse and has requested that the City of Sparks City Council consider the abandonment of four (4) parcels of right-of-way abutting the proposed project boundary (see attached site plan) :

  • Abandonment area 1: A portion of the B/C alley right of way and a portion of 13th Street right of way as described in Exhibits A and B of the order of abandonment (attached) being approximately 14,314 square feet.
  • Abandonment area 2: A portion of Victorian Plaza Circle street right of way as described in Exhibits A and B of the order of abandonment (attached) being approximately 204 square feet.
  • Abandonment area 3: A portion of Victorian Plaza Circle street right of way as described in Exhibits A and B of the order of abandonment (attached) being approximately 201 square feet.
  • Abandonment area 4: A portion of 13th Street right of way as described in Exhibits A and B of the order of abandonment (attached) being approximately 1,481 square feet.

Staff have reviewed the request for abandonment and recommend approval.



Analysis:

The legal descriptions (see attached ) for the requested right-of-way abandonments have been reviewed by staff and have been found acceptable. Each owner of property abutting the proposed abandonments have been properly notified via certified mail as required by NRS 278.480 (4) (a). The extent of the proposed abandonment and the date of the public hearing were published in the Reno Gazette Journal  as required by NRS 278.480 (4) (b). Reservations of easment are (per NRS 278.480 (6)) are included where applicable. Staff finds that the public will not be materially injured by the proposed abandonments and recommends approval.



Alternatives:
  1. The City Council could approve the request for abandonment as outlined by Staff.
  2. The City Council could deny the request for abandonment as outlined by Staff.


Recommended Motion:

"I move to approve the abandonment of four parcels of right-of-way abutting the proposed Fountainhouse project as submitted by staff"
