Title: Consideration and possible approval of an Outdoor Dining and Encroachment Permit to Mummer’s, LLC located at 906 Victorian Avenue.

Agenda Item Brief:

Justin Mumm, owner of Mummer’s LLC, has requested the City’s consideration for an outdoor dining and encroachment permit over approximately 300 square feet of public right-of-way directly in front of the eastern 20 feet of 906 Victorian Avenue.  Staff recommends the Council approve the permit.



Background:

We have a request from Justin Mumm, owner of Mummer’s to encroach fifteen (15) feet into the sidewalk area directly in front of the western 20 feet of the southern frontage located at 906 Victorian Avenue.  This Outdoor Dining and Encroachment Permit is a new agreement (due to a change in ownership) but is of the same form and terms previously used on Victorian Avenue with similar businesses.  The agreement includes review and approval by the City Council, an annual rent payment consistent with the City’s fiscal year, requirement of a Certificate of Insurance and Workman’s Compensation at the time of the annual permit application and general conditions for the protection and upkeep of the encroachment area.  The term of the agreement is for one year and will terminate, unless renewed, on June 30, 2016.



Analysis:

The attached agreement has been reviewed by City Staff and has been found acceptable and consistent with SMC 5.77.100.   Staff Recommends approval.



Alternatives:
  1. The City Council could approve the Outdoor Dining and Encroachment Permit as outlined by staff.
  2. The City Council could reject the Outdoor Dining and encroachment Permit and provide direction to the City Manager.


Recommended Motion:

“I move to approve the Outdoor Dining and Encroachment Permit for Mummer’s, LLC as submitted by Staff.”
