The City has participated in binding arbitration with Police Officer Mark Scott. This settlement is to satisfy the arbitrator's award and to facilitate a settlement allowing Officer Scott to resign employment with the City of Sparks.
Background:
Pursuant to an employment conflict arising between Sparks Police Officer Mark Scott and the City of Sparks, an arbitration hearing took place on March 27-28 and June 3-4, 2014. The Arbitrator's decision was rendered in favor of Officer Scott on January 27, 2015. In recognition of the arbitrator's decision, it is the desire of the City and Officer Scott to settle this matter by the voluntary termination of Office Scott's employment relationship with the City in exchange for the payment of back pay including past and future benefits.
Analysis:
The City Attorney has investigated this matter and believes it is in the best interests of the City, in light of the arbitrator's award against the City, that the settlement of this matter is both cost-effective and prudent.
Alternatives:
1. The City Council may approve the settlement agreement between the City of Sparks and Police Officer Mark Scott.
2.The City Council may not approve the settlement agreement between the City of Sparks and Police Officer Mark Scott.
3. The City Council may direct staff to another alternative.
Recommended Motion:
I move to approve the settlement between Police Officer Mark Scott and the City of Sparks.
