Title: Consideration and possible approval of a Memorandum of Understanding (MOU) between the City of Sparks and Operating Engineers Local Union No. 3 Non- Supervisory to add the title of Legal Office Assistant.

Agenda Item Brief: The City Attorney’s office had a Legal Secretary leave to pursue an opportunity in another department. This departure gave the Department an opportunity to look at the workload and do an analysis of personnel needs. The Legal Department has determined that their office would currently be better served with a Legal Office Assistant who could do the majority of front line clerical duties freeing up the Legal Secretary’s and the Administrative Assistant’s time to support the Attorneys. This under fill in the complement would result in a budget savings in FY15.


Background: Working in conjunction, Human Resources and the Legal Department developed a job description for Legal Office Assistant. After the job description was established, an analysis was conducted to determine an appropriate pay range. It was determined that this position should be added to the Operating Engineer’s contract.

Analysis: The position was then compared to similar positions in the contract such as Police Office Assistant I/II, Office Specialist, Civil Legal Secretary I/II and Criminal Legal Secretary I/II. After that analysis was completed, the following pay range is recommended: Legal Office Assistant OE003 - OE046 $31,013 - $38,188

Alternatives: 1. The City Council may approve the Memorandum of Understanding with Operating Engineers Local No. 3. Supervisory 2. The City Council may not approve the Memorandum of Understanding to change the Operating Engineers Local No. 3. Supervisory 3. The City Council may choose not to approve the Memorandum of Understanding with the Operating Engineers Local No. 3 Supervisory, but may provide other direction to City staff.

Recommended Motion:

I move to approve the Memorandum of Understanding with Operating Engineers Local No. 3.
