Background: The Northern Nevada Community Housing Resource Board (NNCHRB)is the owner of property located at 2555 'D' Street. NNCHRB is in the process of making improvements to the property to provide rent and income controlled housing to our community. As part of these improvements, NNCHRB has the need for additional space to provide security fencing, safe access around the existing buildings, and for exterior amenities. NNCHRB has requested that the City of Sparks City Council consider the abandonment of a portion of the right of way associated with 'D' Street as well as the right of way associated with two alleys adjacent to their property (See attached Site Plan).
Analysis:
The legal descriptions (see attached) for the requested right of way abandonments have been reviewed by staff and have been found acceptable. Each owner of property abutting the proposed abandonments have been properly notified via certified mail as required by NRS 278.480 (4) (a). The extent of the proposed abandonment and the date of the public hearing were published in the Reno Gazette Journal on August 7, 2014 as required by NRS 278.480 (4) (b). All reservations of easment have been recorded in the Office of the County Recorder, Washoe County as required by NRS 278.480 (6). Staff recommends approval.
Alternatives:
- The City Council could approve the request for abandonment as outlined by Staff.
- The City Council could deny the request for abandonment as outlined by Staff.
Recommended Motion:
"I move to approve the abandonment of a portion of the 'D' Street right of way and the right of way associated with two alleys (legally described by six parcels) adjacent to 2555 'D' Street as outlined by Staff"
