Title: Consideration and possible approval of an Agreement for the Adjustment of Utility Facilities for Phase 2 of the North Truckee Drain Relocation Project with NV Energy in the amount of $92,021.
Petitioner/Presenter: John Martini, P.E., Assistant Community Services Director/Andrew Hummel, P.E., Utility Manager
Recommendation: Staff recommends the approval of an Agreement for the Adjustment of Utility Facilities for Phase 2 of the North Truckee Drain Relocation Project with NV Energy in the amount of $92,021.
Financial Impact: $92,021 in Storm Drains Capital Fund 1641. $12,000,000 was approved for Project 14-6820 North Truckee Drain Relocation Phase 1 in the FY14 CIP, of which $0 remains. However, cash reserves, incoming River Flood Fees, and the Reimbursement Agreement with Truckee River Flood Management Authority are sufficient to cover this expenditure.
Total Costs: $92,021.00
Fund: Storm Drains Cap Proj Fund    Account: 604130
Program: North Truckee Drain Relocation Phase I (14-6820)
Amount: $92,021.00    Budget Status: Over Budget (See Budget Correction Plan)
Budget Correction Plan:
The agreement with Truckee River Flood Management Authority, the City of Sparks will be reimbursed $4,750,000 for eligible North Truckee Drain Relocation construction costs, which should offset project costs over the FY14 CIP budget of $12M.
Business Impact (Per NRS 237):

A Business Impact Statement is not required because this is not a rule.
Agenda Item Brief: The North Truckee Drain Relocation Phase 2 Project will require various electrical utility relocations to accommodate the new drainage infrastructure. NV Energy (NVE) has identified electrical service facilities requiring relocation. As the facilities being relocated are within Public Utility Easements (PUE), the relocation costs are the responsibility of the City of Sparks. A Facilities Relocation Agreement has been prepared for payment of these costs by the City to NVE, and is presented for consideration. Staff recommends approval.

Background: The North Truckee Drain Relocation Phase 2 Project impacts various utility facilities. During the course of design, Truckee Meadows Water Authority (TMWA), Nevada Energy (NVE), Charter, AT&T, Verizon, and other known utility companies were notified and coordination ensued to ensure relocation needs were determined and properly included. The majority of utility relocations were included in the Phase 1 project; electrical facilities impacted with the Phase 2 project were not included due to impacts to private property. Cost to relocate facilities located with Easements is not eligible for reimbursement, and as such the City must pay to relocate those facilities located as such. Negotiations with NVE have resulted in a Facility Relocation Agreement for electrical facilities impacted by Phase 2. Scope of work included in this Adjustment Agreement includes removal and relocation of an existing pole, removal of above and below ground conductors, and installation of new underground conductors and a vault structure. All facilities are located within Public Utility Easements outside of Right-of-Way; as such the cost to perform the work is the responsibility of the City of Sparks. Total estimated cost to the City is $92,021. Staff recommends approval.

Analysis: Approval of the presented Agreement for the Adjustment of Utility Facilities will allow NVE to recuperate costs incurred in relocating infrastructure owned by NVE and located outside of City Right-of-Way.

Alternatives: 1. City Council could approve the Agreement for Adjustment of Utility Facilities as outlined by Staff. 2. City Council could reject the Agreement for Adjustment of Utility Facilities and provide direction to the City Manager.

Recommended Motion: I move to approve an Agreement for the Adjustment of Utility Facilities for Phase 2 of the North Truckee Drain Relocation Project with NV Energy in the amount of $92,021.
