Agenda Item Brief: Possible final resolution of a claim presented to the City by Ms. Dana Shugar resulting from a fall over a raised section of asphalt at Burgess Park.
Background: The City received a claim from Ms. Dana Shugar. The City’s Risk Management Committee approved the settlement amount reached between the City Attorney and Ms. Dana Shugar. Pursuant to the negotiations, and upon the recommendation of the City Attorney and Risk Management Committee, the City Council is now being asked to approve the settlement of the claim for $38,000.00.
Analysis: The Risk Management Committee, through Mannos and Associates, has investigated this matter and believes that settlement is the most cost effective manner in which to resolve this matter.
Alternatives: The City Council could accept or deny the settlement based upon information it receives from the City Attorney during the attorney client session.
Recommended Motion:
Approval of Settlement: If the City Council decides to approve the settlement offer, the motion should state: "Based upon the advice provided by the city’s attorney, I move to approve the settlement of all claims presented by Ms. Dana Shugar for a total amount of $38,000.00".
Rejection of Settlement: Alternatively, the City Council can reject the proposed settlement. If the City Council decides to reject it, the motion should state: "I move to reject the settlement of the claim against the City presented by Ms. Dana Shugar."
