Title: Consideration and possible approval of the abandonment of an approximate 1,739 square foot parcel being a portion of Marietta Way as shown on MAP TO OFFER FOR DEDICATION THE EXTENSION OF MARIETTA DR., FREEPORT BLVD. & GREG ST. TO CITY OF SPARKS, NEVADA, Tract Map 847, filed as Document No. 393602 in the Office of the Washoe County Recorder, Washoe County, NV on September 6, 1963 situate within the northeast quarter of Section 17, Township 19 North, Range 20 East, M.D.M.

Recommendation: Staff recommends Council approve the abandonment of the approximate 1,739 square feet of Marietta Way right-of-way adjacent to APN: 034-112-43 described as being a fraction of the northeast quarter of Section 17, Township 19 North, Range 20 East, Tract Map 847, filed as Document No. 393602 September 6, 1963.

Agenda Item Brief: Consideration and possible approval of a request from Nevada Land Investors, LLC to abandon an approximate 1,739 square foot portion of Marietta Way right-of-way granted to the City as Dedication Tract Map 847 as further described in the attached Exhibit “A” and as depicted in the attached Exhibit “B”.


Background: The width of road right-of-way on Marietta Way is 40 feet. Nevada land Investors, LLC, as the adjacent owner of the property located at 1705 Marietta Way has requested the abandonment of the 1,739 square feet adjacent to his existing property. The property requested for abandonment is all located behind the existing curb line and the sidewalk. The proposed abandonment will allow for the future expansion of the 1705 Marietta Way property.

Analysis: Staff recommends the Council approve the abandonment request from Nevada Land Investors, LLC to vacate approximately 1,739 square feet of that portion of Marietta way, as described in the attached Exhibit “A” and as depicted in the attached Exhibit “B” The right-of-way proposed for abandonment is not required for road purposes now or in the future. The abandonment of the road right-of-way will return a 1,739 square foot parcel to the tax rolls, and encourage future expansion of the adjacent property.

Alternatives: 1. The City Council could approve the abandonment as outlined by staff. 2. The City Council could reject the abandonment and provide direction to the City Manager. 3. The City Council could direct the City Manager to provide alternatives to this proposal.

Recommended Motion: I move to approve the vacation of a portion of Marietta Way as outlined by staff.
