Title: Consideration and possible award of an informal bid to Gerhardt and Berry Construction Inc., in the amount of $56,824.80 for the off-haul and backfill of impacted and solid waste material encountered during excavation activities on the Regional Transportation Commission Southeast Connector, Phase I Project.

Recommendation: Staff recommends City Council award the informal bid to Gerhardt and Berry Construction Inc. in the amount of $56,824.80.
Financial Impact: There is no General Fund impact. The City of Sparks will manage the excavation and disposal of the impacted and solid waste material project using existing TMWRF Operating Budget. Soil remediation costs will be up to $56,824.80, which includes $5,000.00 as a force account. This expense will be charged to TMWRF, Fund 5605, Account 603507, Site Improvements-Non Cap, under Program 131500, TMWRF Administrations, sub program of 101, Soil Remediation. Following quarterly reconciliation of TMWRF’s operating expenses, affecting the Sanitary Sewer Operations fund (1630), Sparks is expecting reimbursement from the City of Reno based on actual flow splits provided by ADS Environmental as outlined in the interlocal agreement for the operations of the facility, for the actual cost of this contract. The flow split for fiscal year ending June 30, 2013, was 32.39% / 67.61% for the Cities of Sparks and Reno respectively and the approximate split is outlined in Table 1 (attached).

Agenda Item Brief: The City of Sparks has secured contractor bids for the off-haul of the impacted soil/solid waste that is currently stockpiled onsite (approximately 1,700 cubic yards) and the activities proposed in the remedial action plan (excavation/disposal of approximately 1,100 cubic yards of impacted soil/waste and import and placement of backfill material).


Background: The project scope identifies the need to secure required permits, excavate and dispose of impacted and solid waste material to the Waste Management Lockwood landfill, and place backfill material in an area identified in the bid specification. The City of Sparks received six (6) informal bids for this project, which were received on October 24 at 9 AM. A bid summary of the qualified bidders is shown below: • Gerhardt and Berry $ 56,824.80 •Clean Harbors $59,665 •Peavine Construction $76,460 •Q&D Construction $90,785 •Sierra Nevada Construction $97,007

Analysis: On March 27, 2013 Kiewit encountered solid waste (trash, metal wood, and miscellaneous solid waste) and impacted soil during excavation activities associated to Retention Basin #1 on the Regional Transportation Commission (RTC) Southeast Connector, Phase I Project. The property where the solid waste and impacted material was discovered is jointly owned by the City of Sparks and City of Reno. Approximately 6,000 cubic yards of the solid waste material was excavated of which approximately 1,700 cubic yards was stockpiled onsite with the remaining material being transported to an offsite material storage facility secured by the RTC. CH2MHill, a RTC consultant, collected several composite soil samples from the excavated material for analytical testing. Hydrocarbon range organics (TPH-diesel and TPH-oil) were reported in the soil samples. Two release reports associated with the impacted material are on file with NDEP. The first release/spill report (NDEP Spill Report #130409-01) was associated with the trash/solid waste. The second release/spill report (NDEP Spill Report #130503-01) was associated with the impacted soil. In May 2013, the City of Sparks retained McGinley and Associates (MGA) to provide consulting services associated with the on-site impacted material. In June 2013, MGA conducted a Phase II Environmental Site Assessment (ESA) in the impacted area. The investigation included excavating 28 exploratory test pits and collecting soil and groundwater samples. MGA also conducted a limited Phase I ESA to identify potential source(s) of the impacted material. The results of the ESA activities were presented in the report entitled “Results of Environmental Site Assessment Activities and Work Plan for Soil Remediation, October 2, 2013”. The findings of the Phase I ESA could not truly identify the specific source(s) of the solid waste and impacted soil. Steamboat Creek originally traversed through the area where the solid waste and impacted soil were discovered. The creek was re-configured to its current configuration in the 1960’s by the U.S. Army Corp of Engineers. Much of the impacted material is located in the area where a former “ox-bow” was located. One theory is that the ox-bow became a waste disposal area (un-permitted landfill) when it dried up following the reconfiguration of Steamboat Creek. The Washoe County Health Department and Waste Management have granted approval to dispose of the impacted and solid waste material at the Lockwood landfill. RTC has assumed responsibility for the disposal of the material that was transported offsite.

Alternatives: 1. The Council could award the informal bid as outlined by staff 2. The Council could reject the informal bid and provide direction to the City Manager

Recommended Motion: “I move to award the informal bid to Gerhardt and Berry Construction Inc., in the amount of $56,824.80 for the off-haul of impacted and solid waste material encountered during excavation activities on the Regional Transportation Commission Southeast Connector, Phase I Project.”
