Agenda Item Brief: Construction of the North Truckee Drain realignment project will require substantial acquisition of easements and right-of-way for both construction access and permanent facilities. The property owner associated with this item is affected by the project, and an offer totaling $129,152 for easements was presented and accepted by the property owner. Approval of the payments is being presented for consideration by City Council. Staff recommends approval.
Background: In order to construct the North Truckee Drain Realignment project, numerous easements will be required to establish Temporary Construction Easements and Storm Drain Pipeline Easements. A total of 18 parcels are identified as having easement impacts, comprised of a minimum of 12 unique owners. On June 11, 2012, City Council approved a contract with Warren and Schiffmacher to prepare appraisals of the subject properties in order to proceed with construction of the North Truckee Drain Realignment project. On July 8, 2013, City Council approved payment for the first property acquisition with F&M Properties. On AUGUST 26, 2013, City Council approved payment for five (5) additional property acquisitions with SKK Properties, LLC; John and Bonnie Phillips, Trustees; Washoe County School District; Leo R. Tuccori Family Limited Partnership; and Peavine Leasing, LLC. Upon completion of the Appraisal, Review Appraisal, and several site visits with the owner of the parcel affected by this staff report the necessary documents were prepared. For this property, six (6) easements were acquired: four (4) Temporary Construction Easements, one (1) Storm Drain Pipeline Easement, and one (1) Sanitary Sewer Pipeline Facilities Easement. Negotiations with the property owner resulted in preparation of a Letter of Understanding regarding modifications to be made to the property as a course of construction to accommodate truck and delivery access for the owner’s tenants. The modifications include such things as temporary driveway widening, temporary pavement, a temporary loading dock, secure fencing of work areas, removal and replacement of site facilities (trash enclosures, bollards, etc), and special work hours for certain portions of the work. Additionally, the owner requested written confirmation that the Temporary Construction Easements would be abandoned upon completion of the work in the subject property.
Analysis: The Easement areas required to construct and operate the North Truckee Drain project have been carefully considered to ensure project needs are met while reducing property impacts. Offer valuations for the temporary and storm drainage pipeline easements were determined using the Uniform Standards of Professional Appraisal Practice. Appraisal review was provided by Kimmel and Associates with no concerns noted.
Alternatives: 1. City Council could approve the Payment as outlined by Staff. 2. City Council could reject the Payment and provide direction to the City Manager.
Recommended Motion: I move to approve the payment totaling $129,152 to GV, EGC, LLC for Temporary Construction Easements, Storm Drain Pipeline Easement, and Sanitary Sewer Pipeline Facilities Easement for the North Truckee Drain Project.
