Title: Consideration and possible approval to appoint a new Fire Chief for the City of Sparks, and consideration and possible approval of the applicable employment contract.

Recommendation: That the Council confirm the appointment of Thomas R. Garrison to the position of Fire Chief, and approve the Employment Agreement, as recommended by the City Manager as outlined by staff.

Agenda Item Brief: With the retirement of Fire Chief Andy Flock, it is necessary to appoint a new Fire Chief, and to finalize an employment agreement with the new Fire Chief.
Background: With the impending retirement of Fire Chief Andy Flock on September 13, 2013, Division Chief Thomas R. Garrison was appointed to be the Acting Fire Chief. The City Manager has asked Division Chief Garrison to consider the position of Fire Chief on a permanent basis. The City of Sparks provides employment to various levels of employees to provide services for its citizens. The City’s personnel complement includes Civil Service positions who fall under guidelines and regulations provided by the Civil Service Commission and appointed employees who fall under the guidelines and regulations provided by the City Council under the management of the City Manager. Executive employees of the City they fall under the appointed class of employees and are subject to the rules and regulations of the City and have their salaries and benefits provided by an employment contract and/or a Resolution denoting certain employee positions as Executive Employees. These Executive Positions also are covered by individual Employment Agreements. Under the City’s current Executive Resolution, the position of Fire Chief is defined as an ‘appointed’ position. When the position of Fire Chief is vacated, it can be simply appointed by the City Manager and confirmed by the City Council or a full recruitment process may ensue.
Analysis: The City’s Fire Chief, Andy Flock, will retire effective September 13, 2013. The position was filled on an interim basis by Division Chief Thomas R. Garrision to ensure a smooth transition period. The City Manager has had the opportunity to work with Division Chief Garrison on a close basis during the last several years, and to evaluate his performance in a senior leadership role. The City Manager, through review of Division Chief Garrison’s experience, performance in the Division Chief role, and interview, has selected Thomas R. Garrison as his choice for the position of Fire Chief.
Alternatives: 1. The Council may choose to confirm the appointment of Thomas R. Garrison to the position of Fire Chief, and approve the Employment Agreement, as recommended by the City Manager as outlined by staff. 2. The council may choose not to confirm the appointment of Thomas R. Garrison to the position of Fire Chief, and approval of the Employment Agreement, as recommended by the City Manager and as outlined by staff. 3. The Council may choose not to confirm the appointment of Thomas R. Garrison to the position of Fire Chief, and not approve the Employment Agreement, as recommended by the City Manager as outlined by staff, and could direct the City Manager to seek other alternatives.
Recommended Motion: I move to confirm the appointment of Thomas R. Garrison to the position of Fire Chief, and approval of the Employment Agreement, as recommended by the City Manager as outlined by staff.
