Agenda Item Brief: The City of Sparks recently adopted the 2012 International Building code (IBC). The former building code was consistent with the Zoning code (Title 20 ) in that both required a building permit for an accessory structure (i.e. sheds) when the roof area exceeded 120 square feet. The “new” IBC doesn’t require a building permit for an accessory structure until the roof area exceeds 200 square feet. It may be appropriate to initiate a code amendment to the Zoning Code (title 20) to reestablish consistency between the two codes.


Background: The Sparks Municipal Code is now inconsistent regarding when a building permit is required for an accessory structure. Mayor Martini has received a request to consider revising the code to provide consistency between the local building and zoning codes. The building code now requires a building permit for a shed once it exceeds 200 square feet in size whereas the zoning code requires a building permit once a shed exceeds 120 square feet in size. The planning and building codes were consistent prior to the adoption of the “new” 2012 IBC. This item would direct staff to research and review whether or not it is appropriate to reestablish consistency between the building and zoning codes regarding the threshold for when a building permit is required for an accessory structure such as a shed. Staff may ultimately identify other related changes regarding accessory structures and include them in a code amendment for future City Council consideration.

Alternatives: The City Council may decide not to direct staff to prepare a code amendment.

Recommended Motion: I move to direct staff to initiate a code amendment to Title 20 (zoning code) of the Sparks Municipal Code to consider the size of an accessory structure and when a building permit is required and providing other matters properly relating thereto.
