Title: Consideration and possible approval of Six (6) Outdoor Dining and Encroachment Permits.

Recommendation: Staff recommends City Council approve the six (6) Outdoor Dining and Encroachment Permits between the City and INCA, Inc., The Alley, Cantina Los Tres Hombres, Great Basin Brewery, Victorian Saloon, and the Blind Onion Pizza and Pub.

Agenda Item Brief: City Staff is asking the City Council to approve Outdoor Dining and Encroachment Permits for six (6) previously permitted businesses located on Victorian Avenue.


Background: In March, 2013 all six (6) of the existing Permit holders were notified that their existing Outdoor Dining and Encroachment Permits would be terminated as of June 31, 2013, or on their anniversary date, and a new Outdoor Dining and Encroachment Permit would be prepared and presented for their review and consideration. During the months of March and June, 2013 Staff met with or telephoned all of the Permittees to discuss the changes in the new Permit. Some of their suggestions were incorporated into the revised Permit.

Analysis: The revised annual Outdoor Dining and Encroachment Permit will allow the City Council to review the Permits on an annual basis, eliminate the need for the City to send monthly Invoices to the Permittees, insure the businesses have a Certificate of Insurance, naming the City as additional insured, and Workman’s Compensation Insurance as required by the NRS. The new Permit eliminates the need for the Permittees to Notice the City on the placing and removal of their outdoor dining furniture and fixtures. The Permit also provides for an annual review of the terms and conditions of the Permit, including rent, prior to the issuance of a new Permit. The revised Permit will result in a cost savings to the City, in manpower, records keeping, and oversight, while reducing the paper work of the Permittees, and allowing more flexibility to open and close their outdoor dining furniture and fixtures.

Alternatives: Council could direct staff to provide alternatives.

Recommended Motion: I move the City Council approve the six (6) Outdoor Dining and Encroachment Permits.
