Title: Request for update on legal costs incurred to date related to legal matters between the City of Sparks and the Sparks Municipal Court. For discussion and possible direction.

Recommendation: The City Manager has provided an update on the spending to date on legal matters related to litigation between the City of Sparks and Sparks Municipal Court as requested by the City Council.

Agenda Item Brief: City Council Member Mike Carrigan requested an agenda item to report the spending to date on the legal costs for litigation between the City of Sparks and the Sparks Municipal Court. As of July 31, 2012 the costs for both parties is $207,461.79. Of this amount the City has expended $72,978.85 to Lemons, Gundy and Eisenberg for City Special Counsel and the City has also expended $134,482.94 to Holland and Hart for Special Counsel for the Sparks Municipal Court.

Background: The City and Sparks Municipal Court have both retained Special Counsel to assist in resolving legal matters between the two parties.

Analysis: As of this date the following payments have been made to Special Council to provide legal services in disputes between the City of Sparks and the Sparks Municipal Court. City Special Council Lemons, Gundy and Eisenberg $ 72,978.85 Municipal Special Council Holland and Hart $134,482.94 TOTAL $207,461.79

Alternatives: Cost will continue to accrue for Special Counsel until the pending legal matters are resolved by due process.

Recommended Motion: No Motion is required, unless the City Council wishes to provide direction related to the legal costs to the City Manager.
