BW Sparks, LLC applied for and was granted a Conditional Use Permit (CUP), CU19-0008, to construct an express car wash facility at 4620 Wedekind Road and subsequently submitted for a building permit, SBLD18-23748. The check from BW Sparks, LLC for plan review fees included with the submittal of the building permit application exceeded the amount due for plan review services by $4,115.32.  In anticipation of permit issuance, the excess plan review fees were applied to building inspection fees. However, the applicant’s request to withdraw the permit has necessitated the need to refund the overpayment for services the city will not be providing.  The refund amount is being reduced by $1,400, the amount due on the associated CUP.

The Building division of the Community Services Department received notification from the applicant for the BlueWave Express Car Wash that the project would not be moving forward.  The refund would be reduced by the balance due to the City for processing the CUP. The amount of the proposed refund is $2,715.32.

1. City Council could approve a refund in the amount of $2,715.32 to BW Sparks, LLC.
2. City Council could reject the recommendation and provide direction to the City Manager.

I move to approve a refund of building inspection fees to BW Sparks, LLC in the amount of $2,715.32 in association with the BlueWave Express Car Wash building permit.
